GENERAL TERMS AND CONDITIONS (GTC)

1. Introductory Provisions

The purpose of these General Terms and Conditions (hereinafter referred to as the GTC) is to define the contractual conditions, participation, cancellation, attendance rules, and data processing principles related to the training sessions and gym services provided by Grow Zone (hereinafter referred to as the Service Provider).

1.2. Scope of the GTC

These GTC apply to all electronic commerce services provided within the territory of Hungary via the website www.growzone.hu, concluded between the parties specified above. Purchases are governed by Government Decree 45/2014 (II.26.) on detailed rules of contracts between consumers and businesses.

1.3. Method of Purchase

Purchases made through the website are only possible via electronically submitted orders. Orders sent by phone, fax, mail, or other means are not accepted.

2. Participation Conditions

Through the website www.growzone.hu, the Service Provider offers participation in training sessions.

Registration for training sessions is possible via the website following registration, as well as through personal consultation. Holders of gift vouchers are also required to register online to book an appointment.

By using this website, registering on it, submitting an online application, or recording a personal application, the Applicant declares that they have read, understood, and accepted the participation, cancellation, attendance, service-related contractual conditions, and data processing rules of the Service Provider, and agrees to all of their provisions.

Participants are registered based on the time of submission or personal notification of the application. Payment of the participation fee is carried out in accordance with Section 7.

Application Process for Courses

i. The applicant completes the Google form accessible via the “Registration” button on www.growzone.hu.
ii. The applicant is informed by email about further steps.
iii. Participation fees must be paid in advance either immediately by bank card via the website or using a prepaid voucher. Personal purchases made at the gym are an exception.
iv. The online registration system sends confirmation of the finalized registration/order. Further information regarding the registration/order may be obtained through any of the Service Provider’s contact channels.

3. Communication

Communication with applicants takes place via the email address and phone number provided during online registration or personal application. The Service Provider is not responsible for the availability of the provided contact details or the operation of email services. The Service Provider shall not be liable for any damages arising from unsuccessful communication for these reasons.

4. Participation Fees

The participation fee includes gym entry and, in the case of group classes, instructor fees.
All participation fees are indicated as gross prices.

5. Payment Methods

Payment is possible by bank card, both on-site and via the online platform.

Card payment acceptance is provided by myPOS and Barion under a contractual agreement with the Service Provider, using secure SSL-based systems. During bank card payment, the Applicant is redirected to Barion’s payment page, where transactions are carried out in accordance with international card association regulations and security standards.

The online store does not access, store, or process the Applicant’s card details or underlying account information. Card payments are governed by the rules and procedures of the Barion system.

The Service Provider is not responsible for any operational or availability issues related to the myPOS or Barion systems.

Card data do not reach the merchant.

6. Participation Rules

Participation in training sessions is open to everyone in accordance with these GTC, subject to the following restrictions. The authorized representative of the Grow Zone gym may exclude from participation any individual who:

  • does not meet basic hygiene standards,
  • poses a health risk to other participants,
  • violates house rules,
  • endangers the physical safety of others intentionally or through gross negligence,
  • violates basic ethical norms of group cooperation,
  • deliberately disrupts or obstructs training sessions.

If a participant is excluded for the above reasons, the Service Provider reserves the right to deny future participation in advance.

Participants may use the gym, its facilities, and provided equipment only for their intended purposes and in accordance with these GTC, and are liable for any damage caused by their conduct.

9. Cancellation or Modification of Classes

The Service Provider reserves the right to modify training schedules or announced themes. In case of cancellation or schedule changes, participants will be notified at least 24 hours in advance via email.

Fees paid for cancelled sessions may be used for any future announced class.

Cancellation of Attendance

Cancellation must be completed no later than 1 hour before the session start via the Motibro system. If cancellation does not occur within this time, the system automatically registers the participant as present and deducts the session. Any resulting balance must be settled at the reception before the next visit.

10. Prices

Prices are for informational purposes only and may be modified for business reasons. Price changes do not affect already concluded contracts. In the event of incorrect pricing, the “Procedure for Incorrect Pricing” section applies.

Some products include 27% VAT.

11. Procedure in Case of Incorrect Pricing

Clearly incorrect prices include:

  1. Price listed as HUF 0,
  2. Incorrectly indicated discounted prices (e.g., a HUF 1,000 product offered for HUF 500 with a stated 20% discount),
  3. Prices displayed incorrectly due to external software errors.

In such cases, the Service Provider offers the option to purchase at the correct price, allowing the Customer to either proceed or cancel the order without adverse legal consequences.

12. Cancellation Conditions

If cancellation occurs within 12 hours before the training session, the participation fee is non-refundable.

Cancellations must be communicated via email to growzonefitness@gmail.com, using either the withdrawal form provided in Annex 2 of Government Decree 45/2014 (II.26.) or an unambiguous statement. All other provisions of the Decree apply.

13. Other Provisions

In addition to these GTC, the House Rules and Privacy Policy are available on www.growzone.hu.
Compliance with all provisions contained in these regulations is mandatory for all parties.
